These Terms of Service govern your use of the TukDASH website, mobile applications, TukDASH SACCO services, and TukDASH POS payment features. By creating an account or using our services, you agree to these terms.
Acceptance of Terms
By accessing or using TukDASH, you confirm that you are at least 18 years old and that you agree to be bound by these Terms and any referenced policies, including our Privacy Policy and SACCO Rules.
Description of Service
TukDASH provides a digital mobility platform connecting riders with verified TukTuk operators, a SACCO offering savings, loans, insurance, and health benefits, and a mobile point-of-sale (TukDASH POS) solution that supports M-PESA, NFC, and QR payments.
Accounts & KYC
You must provide accurate and complete information when registering and keep your account details up to date. We may require identity verification (KYC) before activating certain features, including SACCO membership and live payments.
TukDASH POS
TukDASH POS lets drivers, riders, and merchants accept contactless payments using their phone. The interactive demo uses mock data; live M-PESA, NFC, and KYC features activate after a plan upgrade. Merchants and drivers are responsible for the accuracy of the amounts they charge and for fulfilling any goods or services sold.
SACCO Membership
Membership in TukDASH SACCO is governed by the Co-operative Societies Act of Kenya and our SACCO Rules, which form part of these Terms. Savings, loans, and benefits are subject to eligibility and the SACCO's credit policies.
Payments & M-PESA
Payments are processed through Safaricom's Daraja API and authorised payment partners. Transaction fees, where applicable, are disclosed before you confirm a payment. Refunds are handled in line with our partners' policies and Kenyan consumer protection law.
Acceptable Use
- Do not use TukDASH for any unlawful or fraudulent purpose;
- Do not share your account or payment credentials with others;
- Do not attempt to reverse-engineer, disrupt, or overload our systems;
- Do not misuse the POS feature to process payments for prohibited goods or services.
Intellectual Property
All TukDASH branding, content, and software are the property of TukDASH Ltd and protected by Kenyan and international intellectual property laws. You may not copy, reproduce, or distribute our materials without written permission.
Limitation of Liability
To the fullest extent permitted by law, TukDASH shall not be liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim is limited to the amounts you have paid us in the preceding three months.
Disclaimers
Our services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free operation, although we work continuously to maintain a reliable platform.
Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Kenya unless otherwise required by the Co-operative Societies Act for SACCO matters.
Changes
We may update these Terms from time to time. Continued use of TukDASH after changes are posted constitutes acceptance of the revised Terms.
